Gaiap.vn is an online fashion sales website specializing in providing products of GaiAP Co., Ltd

Customers participating in transactions on gaiap.vn are individuals who have full civil act capacity from 15 years of age or older and have assets to make product purchase transactions.

Products traded on gaiap.vn include fashion products, home appliances, etc.

All activities of buying and selling products on gaiap.vn must be done openly, transparently, ensuring the interests of customers. GAI AP will be responsible to customers for all issues related to products provided on gaiap.vn.

By participating in transactions on gaiap.vn, customers are considered to have learned their rights and obligations and agree to be bound by the operating regulations of the website providing e-commerce services https://gaiap.vn is in effect at the time the customer makes the transaction.

Please read these Terms and Conditions carefully (hereinafter referred to as “Terms and Conditions”) before ordering any product/service/gift voucher on GAI AP (hereinafter referred to as “Product”).

1. Scope of application

1.1. Terms and Conditions will apply to customers:

(i) Buy products on GAI AP

(ii) There is a need to deliver Products to locations in accordance with the Shipping Policy posted on GAI AP.

1.2. Customers under these Terms and Conditions (hereinafter referred to as “Customers”) include:

(i) Any individual with full civil act capacity who is at least 15 years of age and has the property to make purchases of Products on GAI AP, except for purchases of registered Products or products otherwise as prescribed by law must be agreed by the legal representative;

(ii) All organizations are legally established and operating in accordance with the laws of Vietnam.

2. How to form a contract

2.1. Any product information provided on GAI AP shall in no case be construed as an offer to contract by GAI AP to Customer. The steps to form the Contract are as follows:

Step 1: Customers place an order on gaiap. (“The order”)

Step 2: GAI AP sends Order confirmation (Product list, delivery term, contact phone) to Customer’s email address or sends a message to Customer’s order phone number or updates order status in the Customer’s account management system.

Contractual relationship with Customer is only formed and effective from the time GAI AP sends confirmation as mentioned in Step 2.

2.2. The Customer’s cancellation of the Order (if any) must be done in accordance with the provisions of the Exchange Regulations posted on GAI AP.

GAI AP reserves the right to cancel an Order in the following cases:

Contacting Customer more than 3 times (calling, sending email) without receiving a response. Specifically, it is calculated after 3 phone calls and 24 hours after sending the last confirmation email.

The shipping unit cannot contact the Customer 3 times, the product will be automatically returned to GAI AP and GAI AP will cancel the order. In the event that the Customer has paid for the product in advance, GAI AP will try to contact you again to re-deliver the goods to the Customer or refund the money to the Customer in the same amount previously paid by the Customer.

3. Price and payment

3.1. The price of the Product is inclusive of 10% VAT.

In all cases, the price of the Product does not include shipping charges. Shipping costs are specified in the Shipping Policy posted on GAI AP.

3.2. The Customer pays the value of the Order at GAI AP’s onestepcheckout page.

When the Customer clicks (clicks) on the “ORDER NOW” box to proceed with the payment of the Order, it means that (i) the Customer confirms that the Order information has been reviewed; and (ii) Customer agrees that the Terms and Conditions shall apply to the purchase of Products in such Order.

3.3. GAI AP reserves the right to refuse to accept Customer’s credit card payment in some cases at GAI AP’s discretion.

3.4. To ensure payment safety, Customers note:

  (i) Chỉ thực hiện thanh toán trực tuyến tại cửa sổ liên kết từ GAI AP chuyển đến;

  (ii) Sử dụng và bảo quản thẻ (thẻ tín dụng, thẻ ATM, thẻ mua hàng…) và thông tin tài khoản/thông tin thẻ cẩn thận;

  (iii) Không cho người khác mượn hoặc sử dụng thẻ để mua hàng tại GAI AP. Ngay khi phát hiện giao dịch phát sinh bất thường nào tại GAI AP, Khách Hàng cần liên hệ ngay với bộ phận chăm sóc Khách Hàng của GAI AP để được xử lý kịp thời;

  (iv) Trong mọi trường hợp, với thẻ tín dụng/ghi nợ quốc tế, Khách Hàng vui lòng không để lộ số CVV/CVC/CSC (là mã số bảo mật, bộ ba kí tự số được in ở mặt sau của thẻ) để bảo mật thông tin thẻ;

4. Product delivery

4.1. The Products will be delivered to the Customer’s requested address in the Order at the time specified in the Shipping Policy posted on gaiap.vn or at the time the Customer requests to receive the goods with the delivery time condition. This must be consistent with that Shipping Policy.

In case the Customer wants to change the address to receive the Products, the Customer must call and notify the Customer Care department of the name and contact phone number of the person designated by the Customer to receive the Products as well as the address to receive the Products. . The person designated by the Customer to receive the Products on the Order or by telephone as specified in this Article 4.1 is collectively referred to as the “Consignee”.

When requested by GAI AP, the Consignee must present identification documents such as Identity Card/Citizen ID Card/Passport for the delivery staff to check before receiving the goods.

4.2. The Consignee must inspect the Product and sign the Delivery Note upon receipt of the Product.

Risk and title to the Products will pass to the Customer from the time the Consignee signs the Delivery Note. The Customer needs to keep the Delivery Note for comparison or to solve any problems that may arise related to the Product (if any). After the product return period specified in the Return Policy posted on GAI AP, problems that may arise related to the Product (if any) will be supported and resolved by GAI AP.

5. Exchange and return products

The exchange and return of Products are made in accordance with the provisions of the Exchange Regulations posted on gaiap.vn.

6. Customer care and complaint handling

6.1. In case of any inquiries or complaints,

including but not limited to the quality of the goods/services, the delivery of the Products, the attitude of the delivery staff, the exchange/return of the Products… the Customer. Customer can contact customer service (“Customer Service”) at hotline 0981884668. When contacting Customer Service, Customer must provide the Order number stated in the Order confirmation email or message that GAI AP send to Customer. Customer Care Department will receive and respond to Customers as soon as possible.

6.2. When in need of goods warranty, Customers can contact Customer Service for advice and support.

7. Information security

Regulations on the confidentiality of Customer’s information are implemented in accordance with the Privacy Policy  posted on gaiap..

8. Limitation of Liability

Under no circumstances shall GAI AP be liable for any damage/loss/loss/damage suffered by the Customer after the time the risk is transferred from the GAI AP to the Customer, unless due to GAI’s fault caused by AP.

9. General Terms

9.1. The provisions referred to in these Terms and Conditions are an integral part of these Terms and Conditions.

9.2. GAI AP and the Customer are responsible for performing all obligations set forth in these Terms and Conditions.

9.3 If any part of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Terms and Conditions shall prevail. And this Condition shall not be affected.

9.4. These Terms and Conditions and any issues arising in the contractual relationship between GAI AP and the Customer will be construed and governed in accordance with the laws of Vietnam. Any dispute, difference, claim arising out of/or relating to the content of these Terms and Conditions shall be resolved through good faith negotiation within thirty (30) days. If it cannot be resolved within these thirty (30) days, the above dispute or complaint may be resolved at a competent court agency.
